1. Definition
1.1 “Seller” means Valéria Farkašovská, sole proprietor.
1.2 “Buyer” means any natural or legal person entering into the Contract via the e-shop.
1.3 “Product” means items printed to customer specifications via Gelato.
1.4 “Contract” means the purchase agreement concluded between Buyer and Seller under these Terms.

2. Conclusion of the Contract
2.1 Buyer places an order by adding Products to the cart and submitting the online form.
2.2 The Contract is concluded only when payment is received by the Seller.
2.3 Until payment is received, the order is non-binding.

3. Prices and Payment Terms
3.1 All prices are stated in EUR. Seller is not a VAT payer.

3.2 Payment methods:
a) Online card payment via Stripe (https://stripe.com/sk/privacy)
b) Bank transfer to account: SK80 1100 0000 0029 4520 5602, BIC/SWIFT: TATRSKBX

3.3 Card payments are processed by Stripe, Inc. (USA). Data transfers are protected by Standard Contractual Clauses (SCC).

4. Production and Delivery
4.1 Upon receipt of payment, the order is sent to Gelato AS (Norway) for printing, packaging and dispatch.
4.2 Gelato handles shipping to Buyer’s address.
– Estimated delivery time: 5–14 days from production start.
– Shipping costs and any customs duties are shown at checkout.

5. Right of Withdrawal
5.1 Consumer Buyers have a 14-day right to withdraw under Act No. 102/2014 Coll., starting from the day the goods are taken into physical possession.
5.2 This right does not apply to Products made to Buyer’s specifications or clearly personalized (printed with customer designs).

6. Complaints and Warranty
6.1 Printing defects or transport damage must be reported within 30 days of delivery by email to moltea.clothing@gmail.com, including order number, description of defect and photos.

6.2 Gelato AS will replace defective items free of charge.
6.3 Warranty period for manufacturing and print quality: 12 months (manufacturing defects only).

6.4 Excluded from warranty: normal wear and tear, improper maintenance, damage caused by Buyer.

7. Data Protection
7.1 We process Your data in accordance with our Privacy Policy: https://www.moltea.clothing/privacy-policy
​7.2 Data processors used: Google Analytics, Stripe, Gelato, Wix.

8. Intellectual Property
8.1 Illustrations and graphics on the Website and on Products are the original work of Valéria Farkašovská and her exclusive property, though not formally registered.

8.2 The Ortem and Calder fonts used in designs and on the Website are licensed intellectual property of Adobe Inc. (Adobe Fonts) under a valid Adobe Creative Cloud subscription. Redistribution of font files is prohibited; commercial distribution of static outputs (prints, images, web elements) is permitted.

9. Limitation of Liability
9.1 Seller is not liable for damage caused by improper use of Products.9.2 Seller’s liability is limited to the purchase price of the defective Product.

10. Governing Law and Jurisdiction
10.1 Matters not governed by these Terms are subject to Act No. 89/2012 Coll. (Civil Code) and Act No. 102/2014 Coll. on Consumer Protection.
10.2 Disputes shall be resolved by the courts of the Slovak Republic having jurisdiction over Seller’s registered office.

11. Changes to these Terms​
11.1 Seller may amend these Terms at any time. Amendments take effect upon publication at https://www.moltea.clothing/terms-and-conditions
​11.2 Buyer is obliged to review the current version before placing an order.

12. User Reviews and Content
12.1 POWR Reviews App• We use the POWR Reviews app to collect and display customer reviews and photos.
• By submitting a review, you grant us (and our service providers) a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish and display your review text and photos in any media for marketing and site operation.
• You represent that you own or have permission to post any materials you submit.

12.2 Moderation and Conduct
• We reserve the right to remove or refuse to display any review that is defamatory, obscene, infringing, or otherwise objectionable. • Reviews are provided “as is” without warranty; we do not verify their accuracy.
12.3 Data Processing
• Your review and uploaded images are processed by POWR.io under their terms and privacy policy (https://www.powr.io/privacy).
• You may request deletion of your review at any time by contacting us at moltea.clothing@gmail.com.
